Q. Can the excluded person sue me if we mistakenly serve them alcohol?
Q. Can the excluded person sue licensees if they mistakenly serve them alcohol?
A. No. This is a fully managed self exclusion program and all Count Me Out self exclusions systems and documentation have been legally verified. Ensuring they will not present legal or liability issues for participating members.
Any person wishing to self exclude must undergo an assessment by a health care professional and if suitable for the program the self excluding person signs an agreement to say they fully understand the consequences of self exclusion. The important point to remember is that this is a voluntary agreement and not a contract. The person is asking the community for help and agreeing not to purchase or consume alcohol in any premises they have chosen to self exclude from. They further agree that they release all ‘Count Me Out’ members, their managers and employees from any liability or claims if they fail to comply with their voluntary self exclusion.
